my boss makes her own candles. well she made new scents called "sweet pea" etc. using bath and body works spray. is this illegal? she says anybody could do that.
Is my boss doing something illegal?
no, it is not illegal to use one product to make another. otherwise it would be illegal to sell products that you knit out of yarn someone else makes, or to sell food that you cooked using ingredients someone else grew/made.
Reply:No I don't think that is illegal I mean I don't know anybody that does it but I don't think it is illegal!!
Reply:you are a worry wart. who cares that she mixes stuff and sells it. its not an illegal substance so get over it. you wont go to jail because your boss is making candles. Find yourself a hobby to mind your own spare time.
Reply:I do not think what your boss is doing is illegal.
Reply:It's not illegal as long as she isn't just repacking someone else's product and selling it as her own.
Reply:As long as she's not using the Bath and Body Works name, or advertising that they are made with them, or using their logo, it is probably legal. Laws most likely vary from state to state.
Reply:bath and body works sells spray for you to use as you please. If she decides she wants to use the spray to make her own candles as long as she does not sell the product as her own, what's the big deal. What if instead of making candles she decided to spray her dog or cat with it.... is that ilegal?
Reply:As long as she doesn't sell them, it's legal
Reply:Haha no it's not ?
Reply:I agree with her that anybody could do that, and that B%26amp;B works sells scents to be used as the buyer sees fit.
Reply:it's illegal using someone elses licensed product and using it to make your own
you should report her for violating bath and body works' license agreement
Reply:Personal use is fine--just not resale and b%26amp;bw name cannot be used.

Just read your additional comments. Yes, if she is selling them, there is some infringement issues.
